Terms of Service

1. Definitions

• "Service" — the Boldvio e-commerce platform, websites, APIs, and any related software or content.
• "You" — the person or legal entity accepting these Terms and using the Service.
• "Store" — an online shop you create and operate using the Service.
• "Customer" — anyone who purchases goods or services through your Store.
• "Content" — text, images, video, code, products, and any other material you upload to or generate within the Service.

2. Account Registration

You must be at least 18 years old, or of legal age to form a binding contract in your jurisdiction, to create a Boldvio account. You agree to provide accurate, current, and complete information at registration and to keep it updated. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us promptly at infoboldvio@boldvio.com if you suspect unauthorised access.

3. Subscription, Pricing, and Billing

Boldvio is offered on a subscription basis. Current plans, prices, and included features are listed on our pricing page. By subscribing, you authorise us to charge your payment method on a recurring basis (monthly or annually, depending on the plan you select) until you cancel.

• Fees are exclusive of applicable taxes; you are responsible for any VAT or sales tax that applies in your jurisdiction.
• We may change prices on no less than 30 days' notice; the new price applies to your next renewal.
• Subscriptions auto-renew unless you cancel before the end of the current term.
• We do not offer pro-rata refunds for partial months, except where required by consumer-protection law.
• Failed payments may result in suspension of the Service until payment is resolved.

4. Acceptable Use

You agree not to use the Service to:

• break any law, regulation, or third-party right;
• sell goods or services that are illegal in your jurisdiction or in the customer's jurisdiction (including but not limited to: counterfeit goods, illegal drugs, unregistered weapons, or stolen property);
• send unsolicited bulk email or otherwise engage in spam;
• upload or transmit malware, viruses, or any code intended to disrupt or compromise systems;
• scrape, reverse-engineer, or attempt to derive the source code of the Service except as expressly permitted by law;
• misrepresent your identity, affiliation, or origin of any Content;
• attempt to bypass rate limits, security controls, or usage quotas;
• use the Service to compete with us by building a substantially similar product.

We may suspend or terminate accounts that breach these rules, and we will cooperate with legitimate law-enforcement requests where required by Kosovo law.

5. Your Content

You retain ownership of all Content you upload. By uploading Content, you grant Boldvio a non-exclusive, worldwide, royalty-free licence to host, store, transmit, transcode, and display that Content solely to provide and improve the Service to you. You are solely responsible for your Content and for ensuring you have the rights to use it.

We may remove Content that we reasonably believe breaches these Terms, infringes third-party rights, or is unlawful. Where possible we will notify you first.

6. Customers and Third-Party Platforms

You are responsible for the relationship with your own Customers — including your store's own privacy policy, terms of sale, returns, refunds, taxes, customer support, and compliance with consumer-protection law. Boldvio is the platform; you are the merchant.

Some Boldvio features connect to third-party platforms (Meta, Google Ads, TikTok, Stripe, and others). Your use of those platforms is also governed by their own terms; we are not responsible for their availability, decisions, or actions.

7. Intellectual Property

Boldvio, including the platform software, interface, brand, and documentation, is owned by Kusari Group sh.p.k. and protected by intellectual-property laws. Nothing in these Terms transfers our IP to you. You may not copy, modify, or create derivative works of the Service except as expressly permitted.

We welcome feedback. Any suggestions, ideas, or feature requests you send us may be used without obligation to you.

8. Suspension and Termination

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing term. We may suspend or terminate your account immediately if:

• you materially breach these Terms;
• your account is used for activity we reasonably believe to be fraudulent, abusive, or unlawful;
• continued provision would expose us to legal or regulatory liability;
• required by court order, regulator, or applicable law.

On termination, we will retain your data for 90 days to allow account recovery, then delete it in line with our Privacy Policy. You may export your data at any time before deletion.

9. Privacy

Our collection and use of personal data is described in the Privacy Policy, which forms part of these Terms.

10. Service Availability

We work hard to keep Boldvio reliable and target high availability, but we do not guarantee that the Service will be uninterrupted, error-free, or completely secure. Scheduled maintenance, urgent security patches, force majeure, and issues with upstream providers can cause downtime. Where downtime materially affects you, contact us and we will work in good faith to resolve it.

You agree to defend, indemnify, and hold harmless Boldvio and Kusari Group sh.p.k. from any claim, demand, loss, or damages — including reasonable legal fees — arising from your Content, your use of the Service, your products or services sold via the Service, or your breach of these Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of Kosovo, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15. Disputes

We hope to resolve any dispute amicably. If we cannot, you and we agree that the Basic Court of Pristina, Kosovo will have exclusive jurisdiction, except that consumers in the EU may also bring proceedings in their country of residence as permitted by mandatory law.

16. Assignment and Successor in Interest

You may not assign these Terms without our prior written consent. We may assign these Terms — and transfer your account, data, and contractual rights — to a successor entity in connection with a corporate restructuring, sale, merger, or change of operating company within the same group, on at least 30 days' prior notice by email. Such assignment will not reduce your rights under these Terms or applicable law.

17. Force Majeure

Neither party will be liable for failure or delay in performance caused by events beyond its reasonable control, including natural disasters, war, terrorism, civil unrest, embargoes, government actions, infrastructure or upstream-provider outages, or cyber-attacks beyond commercially reasonable defences.

18. Changes to These Terms

We may update these Terms occasionally. The "Last updated" date at the top will reflect the current version. Material changes will be announced by email at least 14 days before they take effect; continuing to use the Service after that date means you accept the updated Terms.

19. Miscellaneous

• Entire agreement — these Terms, together with the Privacy Policy and any plan-specific terms you accept on signup, are the entire agreement between you and us.
• Severability — if any provision is held unenforceable, the rest of the Terms will remain in effect.
• No waiver — failure to enforce a right does not waive it.
• Independent contractors — nothing here creates a partnership, agency, or employment relationship.
• Notices — we may send legal notices to the email associated with your account; you must keep that address current.
